Diego Yesid continues to be held in the Tunja Battalion after six days of a hunger strike and a promise from military authorities that he would be released. Letter of Support to Diego Yesid Bosa Rico, Conscientious Objector on Hunger Strike

I, or we ____________, express our profound concern for the situation of the young man Diego Yesid Bosa Rico, who was illegally conscripted on the 23rd of February in a street roundup which took place in the Restrepo neighborhood of Bogota, Colombia.

This young man has expressed many times and in many different ways, his refusal to participate in war. Based on his religious and ethical background, he declared himself a conscientious objector on March 18th, 2008. Diego Yesid, has refued to be trained in weaponry and or chant war songs that only talk about killing the enemy. He has refused to sign documents that would solidify a formal relationship with the military, and specifically a document certain officials have tried to force him to sign in which he would voluntarily accept a change in the status of his military service from “high school graduate” to “regular” (this implies a difference of 12 to 24 months of service). He has also refused to wear a uniform, to receive military training and above all, to follow orders that go against his concience.
Diego Yesid has written and made public his declaration as a conscientious objector, sending it to various authorities in charge of recruitment and the defense of human rights in Colombia. An international network that is based in nonviolent beliefs and supports these kinds of cases included Diego in a national and international database which recognizes him as a conscientious objector.

After closely following this case, we were informed that due to the hunger strike which Diego began on March 26th and which ended on March 31st, 2008, you promised to respond to Diego’s possible release within a month’s time. This communication is intended to seek a response as to the point in which the process is now, how it will move forward and how much longer it will be before Diego Yesid is released from the Battalion where he is currently being held.

We wish to make it clear that the international system of human rights recognizes concientious objection as part of the article which grants freedom of concience (universal declaration of human rights) which has been ratified by Colombia in Article 18 of the international pact of civil and political rights, of which Colombia is a member.

Furthermore, one of the recommendations of the human rights commission of the United Nations to Colombia in 2004 was to recognize conscientious objection as a fundamental right, for those young people who want to fulfill alternative service different from that of bearing arms, and that this service not have a punitive character.

Among our concerns with this case is the fact that Diego was conscripted in an openly illegal process, which is known as “a street roundup.” His previos attempt to clarify his military service situation with the Military District #2 was ignored. And more specifically, it worries us that Diego’s signature was falsified and used as reason and evidence that he had accepted, under oath, a loophole outside of the confines of the law, which implies renouncing one’s religious beliefs, ignoring the economic responsibilities he has towards his family and supporting a change in status of his military service.

As you can observe, our support and concern for Diego Yesid, has caused us to direct this letter to all of you, unifying us with Diego in his nonviolent protest for the fundamental right to not participate in war and denouncing all of the arbitrary acts that have been committed not only against Diego Yesid, but also against many young people in this and other battalions of Colombia.

Based on these facts, we request the liberation of Diego within the month, the time period previously agreed upon.

Yo, [your name], expreso mi profunda preocupación por la situación que se esta presentando con el joven Diego Yesid Bosa Rico, quien fue reclutado el día 23 de febrero en una Batida en el barrio Restrepo de la ciudad de Bogotá Colombia.

Este joven ha expresado reiterativamente y de diversas maneras su negativa a participar en la guerra, basado en su formación ética y religiosa, esto lo llevó a declararse Objetor de Conciencia el pasado martes 18 de marzo. Diego Yesid, se ha rehusado a recibir entrenamiento en manejo de armas, a repetir los cantos de guerra que solo hablan de asesinar al enemigo, a firmar documentos que establezcan algún tipo de vínculo con la institución militar, sobre todo teniendo en cuenta que algunos oficiales, han tratado de forzarlo a firmar un documento en donde el acepta voluntariamente cambiar de modalidad de prestación de servicio de bachiller a regular (esto implica cambiar de 12 a 24 meses), a portar uniforme, a recibir el entrenamiento militar y sobre todo recibir ordenes que van en contra de su conciencia.

Diego Yesid, escribió y hizo pública su declaración como objetor de conciencia, enviándola a las distintas autoridades encargadas del tema del reclutamiento y la defensa de los derechos humanos en Colombia, así mismo Diego fue incluido dentro de una base de datos nacional e internacional que lo acoge como Objetor de Conciencia en el marco de una red internacional que trabaja desde la Noviolencia, apoyando este tipo de casos.

Después de hacerle seguimiento al caso, tenemos conocimiento que debido a la huelga de hambre que Diego inició el 26 de marzo y que finalizó el 31 de marzo de 2008 , ustedes se comprometieron a dar una respuesta frente al proceso de posible desacuartelamiento en un plazo máximo de un mes. Ahora queremos comunicarnos con ustedes para que nos informen cómo va este proceso, en que instancia se encuentra y cuanto tiempo falta para que Diego Yesid pueda salir del Batallón donde se encuentra.

Queremos recordar que la objeción de conciencia esta reconocida en el sistema internacional de derechos humanos como una manifestación del artículo del derecho a la libertad de conciencia (Declaración Universal de los Derechos Humanos) que también ha sido ratificado por Colombia en el Art. 18 del pacto internacional de derechos civiles y políticos, del cual Colombia hace parte.

Recordamos también que la Comisión de Derechos Humanos de de las Naciones Unidas en una de sus recomendaciones para Colombia en el año 2004, instó a Colombia a reconocer la Objeción de Conciencia como un derecho fundamental, para aquellos jóvenes que quieren prestar un servicio a su país por una vía distinta a la de las armas, sin que esto tenga ningún tipo de implicación de carácter punitivo.

Entre otras preocupaciones con este caso, esta el hecho de que Diego fue reclutado en procedimiento abiertamente ilegal, como lo es “la batida”, que se desconoció el proceso que el ya había adelantado para definir su situación militar ante el distrito militar No. 2 y con especial atención, nos preocupa la falsificación de la firma de Diego para ponerlo como argumento y prueba de que el bajo gravedad de juramento, supuestamente habría aceptado el freno extralegal, que implica renunciar a sus principios religiosos, desconocer su responsabilidad económica con su familia y avalar el cambio de modalidad de prestación de servicio mencionado anteriormente.

Como podrán observar, nuestro apoyo y preocupación por Diego Yesid, nos motiva a dirigir a ustedes esta carta, uniéndonos a Diego en su protesta noviolenta por la exigencia de su derecho fundamental a no participar en la guerra, y denunciando todas las arbitrariedades que se han cometido no solo con Diego Yesid, sino también con muchos jóvenes en este y otros batallones en Colombia.

Basados en lo anterior solicitamos a ustedes la liberación de Diego en el plazo establecido, es decir, un mes.
